Agreement to Terms

These Terms of Use ("Terms") govern your access to and use of the website bearlendnow.com (the "Site") operated by Cash Loans Bear LLC ("Cash Loans Bear," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Site.

1. Eligibility

You must be at least 18 years of age and a resident of the United States to use our Site and submit a loan request. By using the Site, you represent and warrant that you meet these eligibility requirements.

2. Description of Service

Cash Loans Bear provides a loan-matching service that connects consumers with lenders in our network. We are not a direct lender, credit provider, loan broker, or agent of any lender. We do not make credit decisions and do not guarantee loan approval. Loan approval, terms, and funding are determined solely by the lender. APRs range from 5.99% to 35.99%, and repayment terms range from 65 days to 84 months.

3. Use of the Site

You agree to use the Site only for lawful purposes. You agree NOT to:

• Submit false, inaccurate, or misleading information.
• Use the Site to commit fraud or any other unlawful activity.
• Attempt to gain unauthorized access to our systems, data, or networks.
• Use bots, scrapers, or automated tools to interact with the Site.
• Interfere with or disrupt the operation of the Site.
• Collect personal information of other users without their consent.

4. Intellectual Property Rights

The Site and its content — including text, graphics, logos, icons, images, software, and design — are the property of Cash Loans Bear or its licensors and are protected by U.S. and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any content from the Site without our prior written consent.

"Cash Loans Bear," the Cash Loans Bear logo, and bearlendnow.com are trademarks of Cash Loans Bear LLC. All other trademarks appearing on the Site are the property of their respective owners.

5. User Content

You are solely responsible for any information you submit through the Site. You grant Cash Loans Bear a non-exclusive, royalty-free, worldwide license to use, reproduce, and share your submitted information with lenders in our network for the purpose of providing the loan-matching service.

6. Disclaimer of Warranties

The Site is provided on an "as is" and "as available" basis. We do not warrant that the Site will be uninterrupted, error-free, or secure. We do not guarantee that you will be matched with a lender or that any loan offer will be made. All information provided through the Site is for general informational purposes only and does not constitute financial, legal, or tax advice.

7. Limitation of Liability

To the fullest extent permitted by law, Cash Loans Bear and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Site or any loan obtained through our matching service. Our total liability for any claim arising from these Terms or your use of the Site shall not exceed the amount you paid us, if any, for access to the Site.

8. Indemnification

You agree to indemnify and hold harmless Cash Loans Bear and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.

9. Mandatory Arbitration and Class Action Waiver

9.1 Arbitration

Except as provided in Section 9.3 below, any dispute or claim arising out of or relating to these Terms or your use of the Site shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect. The arbitration shall take place in Los Angeles, California. The arbitrator's award shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

9.2 Class Action Waiver

You and Cash Loans Bear agree that any arbitration or court proceeding shall be brought solely in the individual party's capacity. You and Cash Loans Bear waive the right to participate in a class action, class arbitration, or representative proceeding. No arbitration or proceeding shall be combined with another without the prior written consent of all parties.

9.3 Small Claims Court

Either party may bring an action in small claims court for disputes or claims within the jurisdiction of such court, provided that the action is brought only on an individual basis and not as a class or representative action.

9.4 Governing Law

These Terms shall be governed by the laws of the State of California, without regard to its conflict of law principles. The Federal Arbitration Act applies to the arbitration provisions.

9.5 Opt-Out of Arbitration

You may opt out of the arbitration agreement by sending written notice to support@bearlendnow.com within 30 days of your first use of the Site. The notice must include your name, address, email, and a statement that you wish to opt out of arbitration.

The Site may contain links to third-party websites and services. We do not control and are not responsible for the content, accuracy, or practices of any third-party sites. Your use of third-party sites is at your own risk and subject to their terms and privacy policies.

11. Privacy

Your use of the Site is also governed by our Privacy Statement, which describes how we collect, use, and protect your personal information.

12. Termination

We may suspend or terminate your access to the Site at any time, without notice, for any reason, including if we believe you have violated these Terms. Upon termination, all provisions of these Terms that by their nature should survive termination shall remain in effect, including the arbitration, class action waiver, limitation of liability, and indemnification provisions.

13. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Site after changes constitutes acceptance of the revised Terms.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable.

15. Entire Agreement

These Terms, together with our Privacy Statement and any other policies referenced herein, constitute the entire agreement between you and Cash Loans Bear regarding your use of the Site.
